Several hedge funds heavily shorted LEH during its final days. led by GS. I don't see GS got any problems.
As long as you don't go naked short, you can short, and any investigation will solve nothing, unless they change the law.

As far as recommending short on TV, one fund manager (I forget his name) consistently claimed on CNBC he owned large amount of SDS in 08, and he's proud of it (he should). Not to mention Paulson, the best shorts all time.
